Sample Sales Agreement

This sales agreement (the “Agreement”) dated this ____ day of ______, 20__.

BETWEEN: Royal Lx Ragdoll (the “Seller”) and ________________ ( the “Buyer”).

IN THE CONSIDERATION OF THE COVENANTS and agreements contained in this Sales Agreement, the Seller and the Buyer agree as follows: Kitten/Cat’s information: (the “Kitten/Cat”)

Purchase Price The buyer will adopt the Kitten/Cat mentioned above and pay for the Kitten/Cat with the sum of $ _______________________ (CAD/USD) (the “Purchase Price”, inclusive of $________(CAD/USD) non-refundable deposit). The Buyer will make cash payment with the sum of $_______________________ (CAD/ USD) for the Kitten/Cat at the time when, and at the place where, the Kitten/Cat is received by the Buyer.

*If shipping is required, the final payment must be received prior to booking the flight for the kitten(s).

General Guarantees:

1. The Seller guarantees that the Kitten/Cat is free of any disease at the time of sale to the best of Seller’s knowledge. The Seller is not to be held responsible for any type of common feline infections that are known to affect cats, including FeLV and FIV, as Buyer agrees that these are conditions that are beyond the control of the Seller after the Kitten/Cat leaves the cattery.

2. The Seller will provide the Buyer with vaccination records and deworming records on the pick-up day, _________, 20__. The Seller is not liable for any expense, veterinarian or otherwise, incurred by the Buyer throughout the Kitten/ Cat’s life. The Buyer should take Kitten/Cat to a licensed veterinarian for a health check within 48 hours since the pick-up date. Otherwise, the health guarantee will be null and void.

3. The Kitten/Cat is sold as a household pet only, and will be neutered/spayed by the Seller prior to leaving. If the Kitten/Cat is not neutered/spayed by the time it leaves the Seller, the Buyer agrees to have the Kitten/Cat neutered/spayed by the time of 6-month old. All kittens are spayed/neutered at the Buyer’s expense unless otherwise specified. TICA registration paper will be provided once the proof of spay/neuter is completed, which is signed by a licensed veterinarian and sent back to the Seller. Otherwise, the Seller will reclaim physical and legal ownership of the Kitten/Cat with or without due process of law for breach of the Agreement with no refund of the purchase price.

4. If, during 2 years following the date of purchase, the Kitten/Cat dies from hereditary/genetic disease, Seller agrees to replace the Kitten/Cat with similar quality kitten at Seller’s earliest convenience, should the following conditions be met:

The Buyer shall provide the Seller with a detailed autopsy report from a licensed veterinarian, at Buyer’s expense. The autopsy report should state that the cause of death is unquestionably a genetic or congenital defect, and should include the Kitten/Cat’s microchip number, name, gender, color, date of birth, and the licensed veterinarian’s contact information.
A second examination by a veterinarian of the Seller’s choice corroborates these claims. The costs of transportation, vaccinations, microchip of the new Kitten/Cat is at Buyer’s side under this case.

Buyer’s Guarantees:

1. Under NO circumstances shall the Buyer agrees to have the Kitten/Cat de-clawed. Declawing is amputation and is often the causes of litter box problems ( “inappropriate elimination”). This can lead to abuse or abandonment of the Kitten/Cat, which is a risk that the Seller is not willing to take.

2. The Buyer agrees to provide annual examinations, vaccinations, quality food, fresh water and enough attention to the Kitten/Cat.

3. The Buyer agrees the Kitten/Cat will not be sold or given to any pet shop, research laboratory or similar facility.

4. If the Buyer no longer wishes to keep the Kitten/Cat, the Buyer should return the Kitten/Cat to the Seller at Buyer’s expense. Buyer needs Seller’s approval if Buyer wishes to re-home the Kitten/Cat to a new family.

5. The Kitten/Cat should be quarantined in a private room with toys, food, litter box, and plenty of human-pet interaction for at least the first 7 days. If the Kitten/Cat, within the first 7 days, interacts with Buyer’s original pets that live in the Buyer’s home, all health guarantee will be null and void.

Breach of the Agreement

If the Buyer is found to have violated any of the terms and conditions of this Agreement, the Kitten/Cat is to be surrendered unconditionally to the Seller. The Seller will reclaim physical and legal ownership of the Kitten/Cat with or without due process of law for any breach of the Agreement with no refund of the purchase price. In this case, the Seller’s attorney fees for reclaiming the Kitten/ Cat will be paid by the Buyer.

The seller is obligated only to honor the clauses, guarantees, and solutions explicitly stated in the signed sales contract, a copy of which is provided to the buyer. Any additional requests are outside the scope of the seller’s services and may be declined at the seller’s discretion.

Any personal harassment, intimidation, false accusation, or other inappropriate conduct directed at the seller shall constitute a breach of conduct and may give rise to legal action.
